Fictional is generally neutral in connotation, referring to such things as literary novels and judicial constructions <a fictional story based on real characters>. Fictitious connotes a sham, something either fraudulent or nonexistent <the rancher purported to back the loan with a fictitious herd of cattle> <the teen’s fictitious driver’s license was nothing but trouble>.
