An attorney who takes part in a trial, on either side, is a trial lawyer and a litigator. But increasingly, the term trial lawyer denotes plaintiff’s attorneys who specialize in suits for personal injuries, medical malpractice, and other torts. An earlier distinction was a connotation that trial lawyers enjoyed the front-line advocacy of trials, while litigators preferred behind-the-scenes discovery and pleadings.
